1.2. The Apps are tools for running an online store and are intended for businesses only. “You” means the merchant that installs or uses an App. By installing or using an App, you accept these Terms. If you install an App on behalf of a merchant, you confirm that you are authorized to bind that merchant.
1.3. If you installed an App before October 14, 2026, these Terms apply to you 14 days after we send them to you by email or in the App.
2. Shopify
2.1. Shopify is not a party to these Terms. Your use of Shopify remains governed by Shopify’s own terms.
2.2. We alone, and not Shopify, are responsible for the Apps. Shopify is not liable for any fault in an App or for any harm resulting from installing or using it. Unless Shopify expressly states otherwise, Shopify cannot assist you with installing or using an App.
2.3. We alone, and not Shopify, are responsible for any liability arising from your access to or use of the Apps, including their development, use, marketing, distribution, access, and support, and from our access to, use, distribution, or storage of data relating to you or your store. This does not extend our liability to you beyond Section 9.
2.4. Shopify may suspend or end our access to its platform, or remove an App, at any time at its own discretion. This may make an App unavailable to you.
3. The Apps
3.1. Each App’s features and plans are described on its Shopify App Store listing and in the App. The Apps are provided online, as software-as-a-service, inside your Shopify admin.
3.2. To use an App you need an active Shopify store, a web browser supported by the Shopify admin, and an internet connection. Some features depend on your Shopify plan or on Shopify features available in your store.
3.3. To deliver their features, the Apps add components to your store, such as theme app blocks, checkout extensions, and Shopify Functions, and use cookies or similar technologies as described in our Privacy Policy. These components are removed or stop working when you uninstall the App. Data an App wrote to your store, such as order or customer tags, metafields, and store credit issued, and code you added to your theme yourself, remain until you remove them.
3.4. We grant you a non-exclusive, non-transferable right to use each App for your Shopify store while the App is installed. All rights in the Apps remain with us or our licensors.
3.5. We may update the Apps, including by adding, changing, or removing features, to improve them or to follow changes in the law, security needs, or the Shopify platform. We will notify you in advance of changes to an App’s core functionality and of major feature changes.
4. Your Responsibilities
4.1. You must use the Apps lawfully and in line with Shopify’s terms. You must not:
- provide unlawful content through the Apps;
- copy, resell, sublicense, modify, or reverse-engineer the Apps, except where mandatory law allows it;
- circumvent plan limits, billing, or security measures;
- use the Apps in a way that harms the Apps, other merchants, or Shopify.
4.2. You decide how an App is configured and are responsible for that configuration and its results in your store, including the prices, discounts, fees, shipping rates, payment methods, and messages shown to your customers, and for their compliance with the laws that apply to your store. Check your configuration before making it live.
4.3. Keep access to your Shopify admin secure. Using the Apps involves risks typical of online services, such as malware, phishing, or unauthorized access to your accounts, and an incorrect configuration can change what your customers see and pay at checkout.
4.4. Content you add to an App, such as offer texts, titles, and images, must not be illegal or infringe the rights of others. If we reasonably believe that it is, based on a notice or our own review, we may remove or disable it or suspend the App for your store. Such decisions are made by a person, not by automated tools. We will tell you what we did and why, and you can contest the decision by replying to our message; we will review it and respond within 14 days. Anyone can report illegal content to support@etradepartner.io, stating the reasons, where the content appears, and that the report is accurate and complete to the best of their knowledge, ideally with their name and email address.
5. Fees
5.1. An App may offer free and paid plans. Current plans and prices are shown on the App’s listing and in the App, where you can change your plan at any time.
5.2. Paid plans are billed by Shopify, on your Shopify invoice, under Shopify’s billing terms. A charge applies only after you approve it in Shopify. A free trial converts to the paid plan you approved when the trial ends, unless you uninstall the App or change your plan before then.
5.3. We will give you at least 30 days’ notice of a price increase or a change to the pricing structure of your plan. A higher price applies only after you approve it in Shopify.
5.4. Uninstalling an App cancels its subscription and stops future charges. Fees already charged are non-refundable, except as provided by Shopify’s billing rules or required by mandatory law, and except that if we end the agreement other than for your breach, or discontinue an App, we refund fees paid for any period after it ends. We may also grant refunds or credits at our discretion. Refunds are issued through Shopify.
6. Data
6.1. “Store Data” means data we access from your Shopify store through an App. Our Privacy Policy describes the Store Data we access and how we use it, and how we handle personal data as a controller.
6.2. We use Store Data only to provide, support, and secure the Apps and as described in our Privacy Policy. We do not sell it, and we do not use it, including in anonymized, aggregated, or derived form, to create, train, or improve AI or machine-learning models without your prior consent.
6.3. You authorize us to contact your customers on your behalf where you configure an App to do so, for example to send subscription notifications.
6.4. When an App processes personal data of your customers, such as names, contact details, addresses, and order data, you are the controller and we are your processor under Article 28 of the GDPR. We process that data to provide the App’s features, for as long as the App is installed and until deletion under Section 6.5. We:
- process the data only on your documented instructions, which are these Terms and your App configuration, including as regards transfers outside the European Economic Area, unless EU or Member State law requires otherwise, in which case we will inform you first unless that law prohibits it; we will tell you immediately if we believe an instruction infringes data protection law;
- ensure that persons authorized to process the data are bound by confidentiality;
- take the security measures required by Article 32 of the GDPR;
- may engage sub-processors, such as hosting and infrastructure providers, under the same data protection obligations, and remain responsible to you for them; you give general authorization for this, we provide the current list on request, and we will notify you of intended changes so you can object;
- transfer the data outside the European Economic Area only with safeguards required by the GDPR;
- assist you, taking into account the nature of the processing, with data subject requests and with your obligations under Articles 32 to 36 of the GDPR, including by notifying you of personal data breaches without undue delay;
- at your choice, return the data to you before you uninstall the App, and delete it as described in Section 6.5;
- make available the information needed to demonstrate compliance with Article 28 of the GDPR and allow for audits, including inspections, by you or your auditor on reasonable notice.
6.5. We delete Store Data within 30 days after you uninstall an App, except where EU or Member State law requires us to keep it.
6.6. Under the EU Data Act, you may at any time, free of charge and without notice, ask us to export your data, help you switch to another provider, or delete your data. Your exportable data is: the settings and configurations you created in the App, including rules, offers, bundles, discounts, and fees; statistics the App generated for your store; and the personal data we process for you. Our source code and internal operational logs are excluded. We will provide the export as JSON files, using the field names shown in the App, within 30 days of your request, keep the App running and secure until then, give you reasonable help and information for the switch, and tell you about any known risks to continuity. You can retrieve the export for at least 30 days, after which we delete it, and the agreement ends once the switch or deletion is complete, which we will confirm by email. Make your request before uninstalling, because after uninstallation Shopify ends our access to your store.
6.7. The Apps run on the cloud infrastructure of Cloudflare, Inc. (United States), which operates data centers worldwide. We disclose data to public authorities only where EU or Member State law requires it, or Article 32 of the EU Data Act allows it, after verifying the request.
7. Availability and Support
7.1. We aim to keep the Apps available and working, but we do not guarantee uninterrupted or error-free operation. The Apps depend on Shopify’s platform and APIs, which we do not control.
7.2. We may suspend an App, or your access to it, where needed for maintenance, security, preventing abuse, or complying with the law or Shopify’s requirements, or if you breach Section 4. Where practicable, we will notify you in advance.
7.3. Support is available through the chat in each App or by email at support@etradepartner.io. Our point of contact for users and authorities under the EU Digital Services Act is support@etradepartner.io, in English or Polish.
8. Complaints
8.1. You can submit a complaint about an App to support@etradepartner.io. Please include your store’s myshopify.com domain, the App concerned, and a description of the issue.
8.2. We will respond by email within 14 days of receiving your complaint.
9. Liability
9.1. We are liable only for damage caused intentionally. Any other liability, whether in contract or in tort (Article 443 of the Polish Civil Code), including for gross negligence, is excluded.
9.2. If and to the extent that Section 9.1 is held unenforceable, we are liable only for actual loss, excluding lost profits (Article 361 § 2 of the Polish Civil Code), and our total liability for all claims is limited to the greater of the fees you paid for the App concerned in the 3 months before the event giving rise to the claim and EUR 100.
9.3. The Apps are provided “as is”, without any guarantee of particular results, such as sales or conversion. Statutory warranty for defects (rękojmia) is excluded.
9.4. Nothing in these Terms excludes or limits liability for damage caused intentionally, for personal injury, or any other liability that cannot be excluded or limited under mandatory law.
10. Term and Termination
10.1. The agreement for an App starts when you install it and continues for an indefinite period.
10.2. You may terminate it at any time, without notice and free of charge, by uninstalling the App.
10.3. We may terminate it with 30 days’ notice by email. We may terminate it with immediate effect if you materially breach these Terms, or if Shopify removes the App or ends our access to its platform.
10.4. Sections 6.2, 6.4 to 6.6, 9, 12, and 13 continue to apply after termination.
11. Changes to These Terms
11.1. We may change these Terms for important reasons: changes in the law or decisions of authorities or courts; changes to Shopify’s terms, platform, APIs, or billing; changes to the Apps’ features, plans, or prices; security or abuse prevention; changes to our company details; or correcting errors or clarifying the wording.
11.2. We will send you the new version, or a link to it, by email or in the App at least 14 days before it takes effect, and publish it on this page. If you do not agree, uninstall the App before the change takes effect; continued use after that date means you accept it. A change required by law, by Shopify, or for security may take effect sooner if necessary.
12. Governing Law and Disputes
12.1. These Terms and every agreement for an App are governed by Polish law.
12.2. We provide the Apps from Warsaw, which is the place of performance. The courts competent for our registered office in Warsaw, Poland, have exclusive jurisdiction over disputes, unless mandatory law provides otherwise.
13. Final Provisions
13.1. If you are a natural person entering into an agreement directly connected with your business, and it follows from the content of the agreement, or from your declaration under Article 385⁵ § 1¹ of the Polish Civil Code, that the agreement is not of a professional nature for you (Article 385⁵ of the Polish Civil Code and Article 7aa of the Polish Consumer Rights Act): (a) Sections 9 and 12.2 do not apply to you, and the statutory rules apply instead; (b) other provisions of these Terms do not apply to the extent they would deprive you of protection under those articles; and (c) you may withdraw from the agreement for an App within 14 days of installing it, without giving reasons, by notifying us at support@etradepartner.io, and we will refund any fees charged for that App in that period.
13.2. If a provision of these Terms is invalid, the rest remain in force, and the invalid provision is replaced by a valid one closest to its purpose.
13.3. You may not transfer your rights or obligations under these Terms without our consent. You consent to our transfer of the agreement to a successor of our business.
13.4. We send notices to the email address of your Shopify store, and you can send notices to support@etradepartner.io.
13.5. These Terms are available free of charge on this page, where you can view, save, and print them before installing an App.
